General Provisions

• The "Spotiself" platform is a digital career guidance environment consisting of the student module available online at https://www.spotiself.lt/ and the digital module for career specialists (web address not publicly distributed) (hereinafter collectively referred to as the "Spotiself" platform), administered by MB "Karjeros kelias", legal entity code 304686375, registered office address Liepų g. 83, LT–92195 Klaipėda (hereinafter referred to as the Company).

• These "Spotiself" platform usage rules (hereinafter referred to as Usage Rules) constitute a document that also serves as a contract between the Company and you (i.e. the user of the "Spotiself" platform – a student (hereinafter referred to as Student), a user of the "Spotiself" platform – a career specialist or coordinator (hereinafter referred to as Career Specialist), and collectively referred to as User) for using the "Spotiself" platform. The "Spotiself" platform User, with a non-exclusive license permitting the use of the "Spotiself" platform (hereinafter referred to as License), has access to the content assigned to the User: the career specialist or coordinator has access to digital methodological materials, digital tasks, and task result reports; the student has access to personality and career tests, individual and group tasks, and other platform functionality. A "Spotiself" platform User without a License may access limited content assigned to them for familiarization purposes, if available. The Company is not obligated to ensure that a specific (constant) amount of digital materials or specific digital materials will be available throughout the validity period of the User's purchased/assigned License. The amount of digital content available on the "Spotiself" platform is solely at the discretion of the Company, based on needs and interests.

• Licenses typically are valid for a 1-year period from August 1 to July 31 of the following year, but the Company may, at its unilateral discretion, provide the right for the User to purchase a license for a different period (shorter/longer). Upon expiration of the User's purchased/assigned License, the period is not automatically extended, and to continue using the "Spotiself" platform, a new License order must be submitted and a new license agreement must be concluded.

• The Student confirms familiarity with the Usage Rules by marking an electronic acknowledgment during registration, agreeing to comply with the Usage Rules. The Career Specialist confirms familiarity with the Usage Rules by marking an electronic acknowledgment during registration, agreeing to comply with the Usage Rules. To access the "Spotiself" platform, the User must read and agree to the Usage Rules and the "Spotiself" platform's privacy rules by ticking the boxes, thereby committing to compliance. The confirmed Usage Rules (agreement) are a legally binding document that establishes the terms of using the "Spotiself" platform, the rights and obligations of the parties, liabilities, and other relevant conditions. If the User disagrees with the "Spotiself" platform's privacy rules and these Usage Rules, they are not entitled to use the "Spotiself" platform.

User Registration

• Access to the student module of the "Spotiself" platform (at https://www.spotiself.lt/) is only available to registered Students. Access to the career specialist module of the "Spotiself" platform (address not publicly disclosed) is only available to registered Career Specialists.

• The registration procedure for Career Specialists is completed through a separate, non-publicly distributed link provided after the License agreement is signed, and upon completing the required actions – filling in the requested data, confirming the email, reading and agreeing to the "Spotiself" platform's Usage Rules and Privacy Rules, and/or performing other required actions.

• The registration procedure for Students aged 14 and above is carried out by clicking the active "Register" link on the login page at https://www.spotiself.lt and completing the required steps – filling in the requested data, confirming the email, reading and agreeing to the "Spotiself" platform's Usage Rules and Privacy Rules, and/or performing other required actions. Upon registration, the Student must enter a special code in their account settings to activate full licensed functionality. The code is provided by a career specialist or another authorized person of the Buyer after the License agreement has been signed.

• The rights and obligations of Students under the age of 14, as stipulated in the "Spotiself" platform's privacy rules and these Usage Rules, are exercised by their parents or guardians. The registration procedure for Students under the age of 14 is carried out by clicking the active "Register" link on the login page at https://www.spotiself.lt and completing the required steps – filling in the requested data (including the email address of one of the parents or guardians), and obtaining confirmation from the parent or guardian via email allowing the student under 14 to use the "Spotiself" platform. After registration and parental confirmation, the Student must enter a special code in their account settings to activate full licensed functionality. The code is provided by a career specialist or another authorized person of the Buyer after the License agreement has been signed.

• The User confirms that:

  • The data provided by the User is accurate, precise, and complete. Any losses resulting from providing incorrect data will be the responsibility of the User;

  • In case of changes to the data provided during registration or other related information, the User will promptly update their account details.

• The Student may discontinue using the "Spotiself" platform at any time and unsubscribe by selecting the option to delete the account in the account settings section.

Personal Data Protection

• The processing of personal data provided by the User to the Company is governed by the "Spotiself" platform's privacy policy available at https://www.spotiself.lt. Any other information provided by the User that is not considered personal data will not be treated as confidential, and the Company may use it at its discretion.

Testing Tool Usage Rules

• By agreeing to the Usage Rules, the User confirms that they are informed that their data is and may be used for scientific purposes in the future to improve the testing tool algorithms.

  • The User agrees that their data may be accessed by researchers at Vilnius University directly involved in the development and improvement of the tools. More information is available at https://www.spotiself.lt.

  • Participation in scientific research by the User means answering questions or solving tasks at a convenient time, under suitable circumstances and at their own pace.

Liability

• The User is strictly prohibited from impersonating other individuals, providing false names, surnames, or other data, and violating the rights of the Company or third parties, the legal requirements of the Republic of Lithuania, the Usage Rules, or the moral norms generally observed in society while using the "Spotiself" platform. If a User disregards these requirements, the Company reserves the right to immediately and without prior notice disconnect the User or the entire group of users sharing internet access from the "Spotiself" platform for an indefinite period. The User, upon the Company's request, is also obligated to compensate the Company for damages. If there are reasonable suspicions that the User's actions have caused or may cause harm to the Company, third parties, or the public interest, the Company has the right to forward all available information about the User to the competent state authorities.

• The User is obligated to ensure the confidentiality of their data (including, but not limited to, the License code) and not disclose it to third parties or allow any third parties to use the User's data to access the "Spotiself" platform or for other purposes. If this obligation is not fulfilled, the User is responsible for any actions taken by third parties using the User's data, and all obligations and responsibilities arising from such actions will rest solely with the User. The User must promptly inform the Company if they become aware that third parties are or may be using their login information to access the User's account.

• The Company is not responsible for the information provided on third-party websites, even if the User accesses these sites through active links available on the "Spotiself" platform. The User should note that different terms of use, privacy policies, or other rules may apply on third-party websites compared to the "Spotiself" platform.

Intellectual Property Rights

• The Company holds exclusive proprietary copyright to the "Spotiself" platform. The License to use the "Spotiself" platform is granted to the User only on the condition that they comply with the following conditions of use of proprietary rights.

• The User declares that they understand they are not granted ownership of the "Spotiself" platform or its content and are only granted a non-exclusive License to use the "Spotiself" platform (according to the level of authorization assigned by the Company to the User for the content available to them). The User is prohibited from:

  • Copying or reproducing the "Spotiself" platform or its content in any way. Content that is available for download from the platform by pressing the "Download" button may be downloaded to the User's device and printed solely for personal, non-commercial use, without the right to transfer the content to third parties, and without violating these Usage Rules and legal requirements; and/or

  • Selling or distributing the "Spotiself" platform or its content; and/or

  • Modifying, reconstructing, altering, decompiling, disassembling, or reverse engineering the "Spotiself" platform or its content, attempting to determine the original code of the "Spotiself" platform, or creating derivative products based on the "Spotiself" platform or its content; and/or

  • Renting, sublicensing, or lending the "Spotiself" platform or its content to third parties; and/or

  • Directly or indirectly exporting the "Spotiself" platform or its content;

  • Providing access (sharing login credentials) to the "Spotiself" platform with third parties without written consent from the Company; and/or

  • Using the "Spotiself" platform or its content in any way other than stated in these Usage Rules.

• The User agrees to comply with these Usage Rules and not violate the moral rights of the author as stipulated by the Law on Copyright and Related Rights of the Republic of Lithuania while using the "Spotiself" platform.

• All trademarks presented on the "Spotiself" platform are the property of the Company or legally used by the Company. The User has no right to use them in any way without prior written consent from the Company.

Operation and Changes of the "Spotiself" Platform

• The Company is not obligated to ensure uninterrupted operation of the "Spotiself" platform, as its operation may be affected by factors beyond the Company's control (e.g., errors, malfunctions, or incorrect operations of the User's hardware and software, failures of third-party data transmission networks and their components, etc.). Liability is limited to the extent not prohibited by mandatory legal provisions. The Company undertakes to make all reasonable efforts to ensure the smoothest possible operation of the "Spotiself" platform.

• The Company reserves the right to unilaterally change and improve any part of the "Spotiself" platform at any time without prior notice, provided that its essential functionality is not removed. The Company undertakes to inform the User in advance of scheduled maintenance of the "Spotiself" platform by email and/or SMS.

• The Company reserves the right to unilaterally change the name and/or domain of the "Spotiself" platform at any time without prior consultation with the User, notifying the User no later than 14 calendar days in advance via email and/or SMS.

• The User must inform the Company of any incorrect operation of the "Spotiself" platform they notice.

Sending Notifications and Other Information to the User

• The Company, without violating applicable laws, has the right to provide the User with non-marketing informational messages about the use of the "Spotiself" platform via the platform. The Company may also send notifications and other information to the User at the email address provided. All information sent by email to the User under these Usage Rules is considered received by the User the next business day after sending.

Applicable Law and Dispute Resolution

• Each party must promptly notify the other party of any changes to email addresses or other contact details. If a party fails to comply with this obligation, any notice delivered/sent to the last provided contact details will be considered properly delivered/sent.

• The laws of the Republic of Lithuania govern the execution and interpretation of these Usage Rules. Any disputes related to these Usage Rules shall be resolved through negotiations. If an agreement cannot be reached, disputes will be resolved in accordance with the laws of the Republic of Lithuania.

Amendments to the Usage Rules

• The Company reserves the right to unilaterally amend these Usage Rules at any time without prior notice. Any changes to these Usage Rules will take effect after they are published on the "Spotiself" platform. If the User continues to use the "Spotiself" platform after the changes to the Usage Rules have been published, it is considered that they unequivocally agree to all amendments to the Usage Rules. If the User does not agree with the amended Usage Rules, they lose the right to use the "Spotiself" platform.
